Terms of Use

This English text is a translation provided for convenience. In case of any discrepancy, the Japanese version prevails.

These Terms govern the use of the iOS application "Feelmo" (the "App") and the websites feelmo.jp and docs.feelmo.jp (together, the "Service") provided by Lumo ("we", "us"). By using the Service, you are deemed to have agreed to these Terms.

1. Definitions

1. "App" means the iOS / watchOS application "Feelmo"
2. "Sites" means feelmo.jp and docs.feelmo.jp
3. "User" means anyone who uses the Service

2. Nature of the Service

1. The Service is a wellbeing tool for observing and recording autonomic regulation (the Regulation Score) and supporting daily self-care
2. The Service is not a medical device and is not intended to diagnose, treat, or prevent any disease. Do not use its displays or suggestions as a basis for medical decisions
3. For any health concern or symptom, consult a physician or other medical professional, regardless of what the Service shows

3. Requirements

1. The App requires an iPhone running iOS 17.0 or later; measuring the Regulation Score requires an Apple Watch
2. Devices, connectivity, and communication costs are the User's responsibility

4. Eligibility

Users under 18 should use the Service with the consent of a parent or guardian.

5. Intellectual Property

1. All intellectual property in the Service — programs, designs, text, images, the characters (Energetic, Calm, Neutral, Anxious, Overload, and Tired), and trademarks — belongs to us or rightful owners
2. Users may not reproduce, modify, distribute, or publicly transmit them beyond private use or as permitted by law
3. Sharing screenshots for personal, non-commercial purposes (e.g. on social media) is welcome — please do not alter the content or present it as our official communication

6. Prohibited Acts

Users must not: (1) use the Service as a basis for medical diagnosis or treatment decisions; (2) reverse-engineer, decompile, or disassemble the App except as permitted by law; (3) copy, redistribute, rent, sell, or sublicense the Service; (4) infringe intellectual property, privacy, or other rights; (5) attempt to re-identify individuals from anonymized information; (6) interfere with operation, gain unauthorized access, or impose excessive load; (7) violate laws or public order and morals.

7. Paid Plan (Feelmo Pro)

1. We may offer a paid plan, "Feelmo Pro"
2. Purchases, billing, and cancellation follow Apple's App Store rules; cancel via subscription management in iOS Settings
3. Refunds are handled under Apple's policies
4. Pricing and features will be announced in the App and on the Sites at launch

8. Data

Handling of user information is governed by the Privacy Policy.

9. Data Storage and Device Changes

1. App data is stored only on your device. It cannot be transferred to, or restored on, a new device in cases such as device failure, loss, or replacement
2. The App's CSV export exists so you can keep your own records; it cannot be imported back into the App for restoration or migration
3. For loss of on-device data, we are liable only as set out in Article 11

10. Changes, Suspension, Termination

1. We may change, suspend, or terminate all or part of the Service with prior notice (or subsequent notice in emergencies)
2. As the App runs on-device, we will make reasonable efforts to keep on-device data accessible and exportable after termination

11. Disclaimer and Limitation of Liability

1. We do not warrant that the Service is free of defects in fact or law (including safety, reliability, accuracy, completeness, or fitness for a particular purpose)
2. We are not liable for damages arising from the Service except in cases of our willful misconduct or gross negligence
3. Where we are liable, our liability is limited to ordinary and direct damages, capped at the fees you paid us in the preceding 12 months (for paid users) or JPY 10,000 (for free users)
4. The preceding two paragraphs do not limit the application of mandatory law, including consumer-protection law, and do not apply to the extent they would be invalid under such law

12. Amendments

1. We may amend these Terms in accordance with Article 548-4 of the Civil Code of Japan
2. We will announce the amended Terms and their effective date on the Sites a reasonable period in advance
3. Continued use after the effective date constitutes agreement to the amended Terms

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remainder continues in full force.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over disputes relating to the Service.
